The 7 rule to avoid speeding fines: does the DGT apply it?

We have heard many times about the "7 rule" when it comes to speed radar tolerance margins. This rule says that a radar will jump and fine if the detected speed is "+ 7 km / h" on roads where limits are controlled below 100 km / h or "+ 7 percent" at higher speeds. However, you should know and keep in mind that this rule only applies to mobile radars that are coupled to moving vehicles. Neither fixed radars, nor static mobile radars, nor Pegasus helicopter radar, nor stretch radars "play" with this margin of error, but with different ones.

And this has been-or should at least be-since the BOE issued, in February 2020, the "ICT / 155 / 2020 order regulating the metrological control of the State of certain measuring instruments". This order, which repealed the one in place since 2010, specifies the different percentage values for error margins depending on the type of device used.

The aim of all this was to equate the error margins of static fixed and mobile radars, following an order of the Supreme Court, since they were previously dealt with with different margins. Even so, we were told a few months ago by AEA that the DGT misapplies these margins in the vast majority of penalty sections: here are the details.

In this way, it differs between mobile (static and moving), fixed, stretch and aerial radars (Pegasus and, sure, soon drones). This is how the error margins on speed radars are established today:

-for static fixed and mobile radars, the "5 rule" is used: + 5 km / h up to 100, + 5 percent from 100 km / h.

-for aerial radars, the "rule of 5" is also used: but here, always a + 5 percent.

-for moving mobile radars, the "7 rule" is used: + 7 km / h to 100, + 7 percent from 100 km / h.

-for stretch radars, the "3 rule" is used: + 3 km / h up to 100, + 3 percent from 100 km / h.
